Terms, Conditions & Disclaimer Regarding Acceptance Of User Content

User Content - Memorial Pages

In addition to the general terms, conditions and disclaimer which all users (including those providing user generated content) are subject to, those users providing memorials or related content undertake to be bound by the following additional terms, conditions and disclaimer, and they are deemed to have accepted these terms, conditions and disclaimers by continuing to access the site and/or in forwarding their  content.

Such users should ensure that prior to placing your submission with ' the site' that you have read both the General Terms, Conditions & Disclaimers applicable to all site user and the Terms, Conditions & Disclaimers which apply to you, depending on the service type you are using, as you are deemed to have accepted them by proceeding.

Submission Standards

'The site' is under no obligation to accept any content from its users and publishes solely at its discretion. Where 'the site' decides to publish content which a user has forwarded for the purpose of publication, it does so on the understanding that the user submitting the content has read and accepts the terms and conditions governing submission. The forwarding of such content is taken as full acceptance of these terms, conditions and disclaimer and is taken as acknowledgment that the user accepts full liability for the content of their submission. Submission Standards include: (i) ensuring that your content does not breach advertising legislation or seek to advertise products banned from advertising or promotion (ii) that the user content complies with any previous ruling by the Advertising Standards Authority (iii) that the user content is suitable for family viewing (iv) that the user content does not seek to use offensive language or seek to express offensive material in the form of innuendo (v) that no user content contains sexual material or reference such material (vi) that the user content does not make false or misleading statements, editorial or comment (vii) that all claims contained within the user content can be substantiated to the satisfaction of 'the site' before publication (viii) that the user content contains no reference to competitions, lotteries, raffles, premium phone lines or any get rich schemes (including pyramid schemes) (ix) that the user content does not seek to represent their enterprise, trade or business as part of 'the site' (x) that the user content provides valid contact details and complies with legal requirements such as displaying your company's legal status (i.e. limited company status and company number). 

Users submitting content for the purpose of publication, including advertising content should ensure that it does not contain content of a defamatory, libelous, inaccurate, misleading, fraudulent, dishonest or obscene nature. Any user submitting such content may be prosecuted by the party damaged by their statement and by ‘the site’ for damages and costs. Users should ensure the integrity of their submission as all liability for user content rests with the user. Failure to do so may result in the user being pursued through civil or criminal court.

In addition, users submitting content which they wish to be considered for inclusion on 'the sites' memorial pages, must read, comply and accept the following:

Application for Submission

User submitting content to 'the site' for consideration and potential inclusion in the memorial section of 'the site', should be aware: (i) that no submission may exceed 250 words (ii) that a photograph will only be considered for inclusion at the sites discretion or where 'the site' is satisfied that you are a relative of the deceased (iii) any user providing a photograph for inclusion must have full ownership rights and own associated copyright, and consent to the site copying, editing and amending its properties (iv) the user must also certify that the 'subject' of the proposed memorial is deceased (v) the user must declare as part of their request, their relationship to the deceased (vi) that 'the site' has no obligation to publish any request (vii) any person submitting false, misleading or fake material accepts by way of application to compensate 'this site', pay damages and costs, incurred those their actions (viii) applications requiring additional resources, including time, to process will be rejected, unless the applicant covers such expenses (ix) the user's content will remain on the site strictly at the sole discretion of the site (x) the site reserves the right to remove user content without notice or without providing reasons to the user (xi) 'the site' disclaims any loss, physical, financial or emotional suffered or perceived to be suffered by the applicant in either the rejection of your request or in the publication by another of such content  (xii) 'the site' does not enter into a contract with the user unless explicitly stated, as such the user accepts that the site is not liable for any matter arising from the carrying of your memorial (xiii) 'this site' reserves the absolute right to deny this service to any applicant/user without reason

Suspension of Service

User generated content provided to 'the site' for publication is deemed to be a privilege and not a contractual obligation. 'The site' reserves the right to withdraw this facility without notice and reserves the right to withdraw a users submission without notice or without providing reasons to the said user. 

User Generated Content

In forwarding or submitting content to 'the site' for publication you automatically grant 'the site' the royalty-free, perpetual, irrevocable, exclusive right and license to use, reproduce, modify, edit, adapt, publish, create derivative works from, distribute, perform and display all such material (in whole or part) on the worldwide web and/or to incorporate it in other works in any form, media, or technology as decided by 'the site'. You acknowledge that 'the site' is not obliged to publish any material submitted by you, however by submitting any content to 'this site' including advertising you automatically agree to be bound by the sites terms, conditions and disclaimers

In submitting user content to 'the site' you: (i) warrant that your content is your own original work (ii) that you have the full rights to make it available to 'the site' (iii) you indemnify 'the site' against all damages, legal fees and others expenses that may be incurred by 'the site' as a result of any breach of warranty, legislation, terms, conditions or disclaimer.

Copyright

Private users and business users submitting 'user content' must accept full responsibility and liability for the material they submit for publication, in particular for ensuring that they do not infringe copyright, intellectual property rights or trademarks. In addition, such users accept through the submission of their content to be bound by the copyright statement listed within the general terms, conditions and disclaimer of this site.

Making A Complaint

'The site' endeavours to maintain a healthy business relationship with all users including those using our 'free' services. Unfortunately on occasion, a dispute can arise, in such circumstances 'the site' will seek to meet your concerns in an informal way, however, if such an approach fails we would invite you to forward to us, your complaint using our formal complaints procedure.
